Terms of Service

**Effective date: August 16, 2026**

 

These Terms of Use ("Terms") govern your use of The Shared Cart mobile application (the "App"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

 

1. The App

The Shared Cart is a household shopping-list application that lets users create lists and categories, add and complete items, attach photos, receive on-device item suggestions, and use sharing-related features.

The App may be used without signing in for local features. An eligible account, including Sign in with Apple, may be required for features involving sharing or joining lists. Some features displayed during testing or development may be prototypes and may not yet provide live, real-time syncing. Do not rely on the App as the sole record of essential information.

2. Eligibility

You must be legally permitted to use the App and agree to these Terms. If you are under the age required to enter into a contract where you live, a parent or legal guardian must review and agree to these Terms for you.

3. License and acceptable use

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, as permitted by the applicable app marketplace rules.

 

You may not:

 

- copy, sell, rent, sublicense, distribute, or commercially exploit the App except as permitted by law;

- reverse engineer, decompile, or attempt to extract the App's source code except where applicable law expressly allows it;

- interfere with the App's operation, security, or other users;

- use the App to violate any law or another person's rights;

- upload, enter, or share unlawful, harmful, fraudulent, infringing, or abusive content;

- attempt to gain unauthorized access to an account, device, list, or service; or

- use automated means to overload, scrape, or misuse the App or related services.

4. Your content and responsibilities

You retain ownership of the list entries, notes, photos, names, and other content you enter into the App ("User Content"). You are responsible for your User Content and for having the necessary rights and permissions to use it.

You grant us only the limited rights reasonably necessary to operate features you request. In the current version, list data and item photos are stored locally and are not uploaded to our servers. If cloud sharing or syncing is introduced, updated terms or notices may describe the permissions needed to transmit, store, and display shared User Content to the people you select.

Be careful when placing sensitive information in a list or sharing access with another person. People with access to a shared list may be able to view, change, copy, or remove its contents. You are responsible for selecting appropriate recipients and protecting your device and account credentials.

5. Photos and Smart Photo Add

Camera and photo-library features are optional. You are responsible for ensuring that you have permission to photograph or use any image added to the App.

Smart Photo Add and automatic category suggestions are convenience features. Recognition results may be incomplete, delayed, or incorrect. You should review suggested item names, categories, quantities, and photos before relying on them.

6. Accounts and sharing

You are responsible for maintaining the confidentiality and security of your device and any account used with the App. You agree to provide accurate information and promptly address unauthorized access.

 

Sharing features may depend on Apple or other third-party services, internet access, compatible devices, and future service availability. We do not guarantee that invitations, synchronization, notifications, or access changes will always be immediate or error-free. Removing yourself from a shared list does not necessarily delete the list for its owner or other participants.

 

7. Feedback

If you send suggestions, ideas, or other feedback, you permit us to use that feedback without restriction or compensation to improve, develop, and promote the App. This does not transfer ownership of your personal User Content to us.

8. Third-party services

The App may interact with services provided by Apple or other parties, including the App Store, TestFlight, iOS, Sign in with Apple, camera and photo services, and your chosen email provider. We do not control those services and are not responsible for their availability, security, content, or practices. Your use of them is governed by their own terms and policies.

9. Ownership

The App, including its software, design, branding, graphics, and other materials provided by us, is owned by or licensed to The Shared Cart's developer and is protected by applicable intellectual-property laws. Except for the limited license in these Terms, no rights are granted to you.

10. App changes, suspension, and termination

We may add, change, suspend, or discontinue any part of the App. We may also restrict or terminate access if you materially violate these Terms, misuse the App, create security or legal risk, or if continued operation is no longer reasonably practical.

 

You may stop using the App at any time. You may delete local content through the App and may remove the App from your device. Sections that by their nature should survive termination—including ownership, disclaimers, limitations of liability, and dispute terms—will survive.

 

11. No warranties

To the fullest extent permitted by law, the App is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the App will always be accurate, available, secure, uninterrupted, or free of errors or harmful components, or that data will never be lost.

 

The App is a convenience tool and is not intended to provide medical, nutritional, safety, financial, or other professional advice.

 

Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

 

12. Limitation of liability

To the fullest extent permitted by law, The Shared Cart's developer and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or opportunity, arising from or related to the App or these Terms.

To the fullest extent permitted by law, our total liability for all claims relating to the App or these Terms will not exceed the greater of the amount you paid for the App during the 12 months before the event giving rise to the claim or US $25.

 

Nothing in these Terms limits liability that cannot legally be limited. Consumer-protection rights that apply to you remain unaffected.

 

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless The Shared Cart's developer from claims, liabilities, damages, and reasonable costs arising from your unlawful misuse of the App, your User Content, or your violation of another person's rights. This section does not apply where prohibited by applicable consumer law.

 

14. Governing law and disputes

These Terms are governed by the laws applicable where The Shared Cart's developer is established, without regard to conflict-of-laws principles, except to the extent the mandatory laws of your place of residence apply. Before beginning formal proceedings, you and we agree to make a reasonable effort to resolve a dispute informally by contacting the support email below.

Nothing in this section prevents either party from seeking relief in small-claims court where eligible or limits rights that cannot be waived under applicable law.

15. Apple App Store terms

If you obtained the App through Apple's App Store:

- these Terms are between you and The Shared Cart's developer, not Apple;

- Apple has no obligation to provide maintenance or support for the App;

- to the extent required by applicable law, if the App fails to conform to an applicable warranty, you may notify Apple, and Apple's responsibility is limited to remedies required under its applicable terms and law;

- Apple is not responsible for addressing claims relating to the App, including product-liability, legal-compliance, or intellectual-property claims;

- you represent that you are not located in a country subject to a U.S. Government embargo and are not listed on a U.S. Government prohibited or restricted parties list; and

- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the App Store-related provisions against you.

Your use of the App must also comply with the Apple Media Services Terms and any applicable usage rules.

16. Changes to these Terms

 

We may update these Terms as the App evolves. We will post the revised Terms and update the effective date. If changes are material, we will provide additional notice when reasonably appropriate. Your continued use after revised Terms become effective constitutes acceptance to the extent permitted by law.
